Articles Hung from Property
Neither clothing, curtains, rugs, towels or other articles shall be shaken from or on the windows, doors, balconies, walkways, stairways, or general common elements, nor shall anything be placed on or hung from windows, doors, balconies, walkways, stairways, sills, ledges or railings or thrown from windows, doors, balconies, walkways, stairways, or general common elements.
All window covereings must be approved by the board, appear white, off white or neutral from the exterior of the building.
City Ordinances
Nothing shall be done upon the property in violation of any zoning, health, fire, noise control, police or other government law or regulation. No gasoline or other highly flammable material may be stored in any condominium unit or limited common element.

Common Elements
The common elements shall not be in any manner defaced nor used for making connections of any sort of radio, television, or other devices or equipment of any kind. Common elements shall be used only for the purposes for which they were installed.
Contractors
Contractors are welcome on the property between the hours of 7:00 a.m. to 5:00 p.m. for the purpose of serving a Unit or the Common Areas and Facilities. Contractors are not permitted to park in the Garage or any other reserved type spaces at any time. In the event an emergency occurs after the hours of 5:00 p.m. A contractor will be allowed on property during which time it is necessary to repair the emergency. Contractors whose work may be noisy or disturbing to other residents will be permitted to work Monday through Friday 9:00 a.m. to 5:00 p.m.
Dues /Collection Procedure
Monthly fees are assigned to each unit for common element operating expenses. An invoice is mailed or delivered to each homeowner on approximately the 25th of each month. Fees are due on the 1st day of each month. Any fees unpaid by this date will be subject to late fees. Special assessments are due as specified. Payment of fees should be made to The Metropolitan HOA.

To ensure timely collections of dues management will enforce necessary procedures as written in the Declaration and Bylaws in relation to monthly dues and assessment collections.

Garage Cleaning
The parking garages are cleaned on an as needed basis. Notices are posted to inform homeowners of the scheduled dates.
The clean up of any vehicular fluid leaks are the sole responsibility of the homeowner and should be cleaned promptly to prevent damage to the concrete.
Electrical or Cable Wiring
No electrical or cable TV wiring serving any unit shall be overloaded or misused. No antennas, satellite disks, weather vanes, electrical, telephone or television cables or other wires which extends beyond the exterior shell of the Building shall be placed, connected, erected or maintained upon any unit or common elements unless approved by the Board in advance. (Declaration Article IV, Section 4.02b).
Fees, Charges and Fines
All rates, fees, charges, fines and penalties imposed by the Board against, or due from any Member or Unit may be collected and enforced as an assessment (Declaration Article IV, Section 4.04).
Fitness Center
The center offers a full Cybex and Life Fitness circuit, free weights, treadmills, cross trainers, Stairmasters and other aerobic and strength training equipment. A yoga room is also available. Access is granted via your PCSC access card. Before your first use the center, you must register at the front desk and sign these Rules and Regulations to activate your card. The center is open daily 5:00 AM to 12:00 AM. Additional rules and regulations apply, please refer to Fitness Center Rules.

Floors
Floor area of living rooms, bedrooms and, hallways are required to be covered by carpet with padding and/or rugs with padding so as to lessen sound transmissions between units. No less than 80% of living rooms, bedrooms and hallway floors must be covered (Rules and Regulations p. 3).
Heating and Cooling
The Metropolitan Condominiums produces the buildings heating and cooling from central plants located on the penthouse level. This equipment heats or chills water and circulates it thru the building.
This water circulates thru a fan coil/s located under a window in each unit. The fan in these units is controlled by the apartment occupant by adjusting the thermostat. The electricity that runs the fan is on the KCP&L meter that is billed to the unit occupant directly. All owners are REQUIRED to transfer unit electric service (KCP&L) in to the occupant name on or before closing to avoid disconnection.
The same water that is used to heat is also used to cool, so only one can be produced at a time. Only twice per year (spring and fall) does the building switch from heating to cooling or vise versa. Changing your fan coil filters frequently will save energy and keep you unit more comfortable.
The Metropolitan Condominiums Association charges each unit “Heating & Cooling” and “Water & Sewer” separately each month in your monthly HOA bill.
Insurance
In accordance with the Bylaws, the Association has a master insurance policy that covers the common elements of the building and the properties' related insurance needs. Homeowners units are not included in this coverage. Homeowners are required to carry homeowners’ liability insurance. A copy must be provided to the management agent and updated in the event changes are made.

Land Use
All units, the limited common elements appurtenant to the units, and the general common elements shall be used, occupied and maintained only for residential purposes. The owner may maintain an office area in a unit so long as (i) the office is not in violation of any zoning or other laws, ordinances or regulations of the City or other applicable governing bodies, (ii) the Owner complies with all relevant laws, ordinances or regulations of the City or other applicable governing bodies, and (iii) the Owner does not utilize any portion of the Common Elements for business purposes. (Declaration Article IV, Section 4.01b).
Laundry Facilities
The laundry facility is located on B1 across from the elevators. The service is provided by Jetz Service Company. The machines are coin-operated.
In reference to the change machine; Regency owed the one that was there, they came and removed it due to it wasn't meant for the laundry machines. Dana, property manager; checked with Jetz in reference to a changer but it is really expensive so she is thinking of another way to accommodate. We apologize for any inconvenience and thank you for your patience.
Jetz provide all service to the laundry machines. If you have a problem or require a refund, please contact them directly at 1-800-530-5726. The Metropolitan Condominium will not be responsible for damage done to personal items and is unable to provide refunds.
Leasing
All leases shall be in writing, shall be in a form supplied and approved by the Board, and shall be subject to the Declaration, Condominium Plat, By-Laws and rules and regulations duly adopted by the Board per Declaration of Condominium Section 4.01, paragraph 9. The Lease Application along with a $45 credit report and background check fee (one per lessee) must be completed and submitted to the board ten (10) business days prior to the tenant moving in to the unit. Please see the concierge for a Lease Approval Package (Rules and Regulations p. 2).
The owner of any leased unit shall promptly deliver a copy of the lease and amendments to the Board. No unit may be made available for use on a transient basis. Lease terms must be for no less than one (1) year. Occupancy of a unit by a person or persons who is not the owner, whether or not pursuant to a written lease or occupancy agreement, even if for no charge, monetary or otherwise, shall be deemed to be “leasing” of the unit and an acceptable lease is required.
The occupancy of the unit shall be subordinate in all respects to the provisions of the Condominium Documents and any violation of the Documents shall constitute a default under the lease. The homeowner will be held liable for any damage or infraction incurred as a result of their tenants(s). Tenants should complete a Resident Registry prior to moving in. Please refer to the association Bylaws for additional leasing information.
The Board shall have the right to reject any such tenant(s) at its sole discretion (which rejection by the Board must be Approved b y the Board), subject to any limitations imposed by law.

Lounge
The lounge is open to all residents from 8 am to 11 pm. For special events reservation is required. Please refer to Lounge Reservation Contract for more information on rules and regulations.
Mail Delivery/Mail Keys
The mail is delivered to the mail centers located within the entrance lobby. Homeowners may obtain keys from the Concierge Desk. If you are having problems with your mailbox please consult management.
Although the concierge may sign for a package, the building is not responsible for any lost, damaged or perishable items (i.e. flowers or food). All pick-ups of items require owner's signature.
When UPS, FED EX, USPS or DHL delivers packages your mail box will be tagged. Bring that tag to the front desk and you will be asked to sign for the package. At that time the person working the front desk will retrieve your package. If a package is not picked up in 7 days you will be contacted by phone or letter. Packages will be sent back to sender after 30-days.
Moving In/Out
Owners and tenants should contact the management least 24 hours prior to the date of the move. The management team can assist you with a key to the elevator and can facilitate name changes at the front gate, intercom and mailbox.
Please be careful and mindful of your new or past neighbors while moving. Use the sidewalks and avoid blocking handicap spaces. You are responsible for any and all damages caused by anyone assisting you with your move.
Moving trucks are NOT permitted in the parking garages.

Noise Issues
Unit owners, their tenants and guests, shall not make any disturbing noises within the units, nor do anything that will interfere with the rights, comfort or convenience of other unit owners, and shall not play any musical instruments or phonograph, radio or television if it will disturb or annoy any residents of the building in which the unit is located or in any other building. No vocal or instrumental instruction may be performed in any unit. Contractors whose work may be noisy and disturbing to other residents will be permitted to work Monday through Friday between the hours of 9:00 a.m. and 5:00 pm.
Open Windows
In order to prevent breakage of water pipes during colder months of the year resulting in damage to Units and Common Areas, increased Common Expenses and increased insurance premiums or cancellation of insurance policies due to numerous damage claims, the thermostats within the units shall be maintained with the heat in an “on” position and at a minimum of fifty (50) degrees Fahrenheit.
Parking Garage
Parking in a space unassigned will be ticketed immediately – after 2 hours if not moved it will be towed!
Parking facilities are not to be used for abandoned or inoperable vehicles or motorcycles. Recreation vehicles and trailers are not allowed. A vehicle will be deemed inoperable if not “street legal” or with expired tags. Vehicles must be locked at all times. Repairs and maintenance to vehicle or motorcycles on the parking lot grounds is prohibited (Rules and Regulations p. 2).
Parties
No owner, guest, or tenant or any other person shall have loud parties or play loud stereo equipment or musical instruments in a loud manner or otherwise permit or make loud noises audible outside its unit (Declaration Chapter IV, Section 4.01n).

Patio
The Patio is available for rental between 8:00 a.m. and 11:00 p.m. seven days per week. A portion of the patio with the grill can be reserved in 4-hour time periods. If more than four hours are required please see manager prior to rental time. A reservation contract is required for parties over 4 individuals. Pets, Vermin and Insects
Homeowners who have pets are asked to adhere to the following rules per Declaration, Section 4.01(L):
- No animals, vermin, insects, reptiles, birds, rabbits, livestock, fowl or poultry of any kind shall be kept, raised or bred in any Unit or in any portion of the Condominium.
- Unit owners may keep 2 caged birds, one cat and one dog (which shall not exceed 40 pounds in adult weight), or one dog (which shall not exceed 40 pounds in adult weight) per household in their unit as pets as long as they are not a nuisance or annoyance to other unit owners.
- Pets must be on a leash at all times when on The Metropolitan common areas.
- 4. Any such animal shall not be allowed in the Common Elements except for immediate transportation to and from the Unit via freight elevator and in B1 and B2 exit levels so as to not disturb the lobby.
- The unit owner is responsible for any pet related incident that causes clean up or damage.
- Pet owners are required to properly remove and discard solid waste. In order to preserve landscaping, pets are to be walked away from the building to the open spaces of the property for relief.
- All pets must be current on their vaccinations.
- Pets who become a nuisance to other residents, i.e. barking, aggressive behavior, damaging property, biting, etc. are subject to removal.
- Fish maintained in a household aquarium shall not be deemed to be “animals” as defined herein, but all aquariums shall be properly maintained and kept completely free of any leakage or overflow, and any spills or leakage occurring.
- Pet owners must comply with all rules and regulations governing pets.
- All pet owners should fill out a registration form and should be approved by the Board. Link to form
- No vermin, insects or other pests shall be allowed to remain in any condominium unit or limited common element nor shall any such unit or limited common element be permitted to remain in an unclean or unsanitary condition. In order to assure compliance with this, the Board, its agents, employees and contractors may enter any unit or limited common element at any reasonable hour after giving reasonable notice of an inspection or extermination of such vermin, insects or other pests. 24 hours is considered to be reasonable notice for such an inspection.
Pool
The pool area on the East side of the penthouse is available to condo owners only. Pool is available from 5am – 11pm seven days a week. The Pool Area can be used for parties in 4-hour time periods. If more than four hours are required please see manager prior to the party. An insurance certificate is required from the condo owner’s insurance company listing “The Metropolitan Condominium Association” as additional insured. The insurance company must fax the certificate of insurance to the concierge upon application. Additional rules apply, for more information see Pool Party Contract.

Realtors
Homeowners who wish to use the services of a realtor may do so as long as all of the rules and regulations regarding the sale of a unit are followed:
- Signage or advertising is not permitted inside or outside of the buildings/windows.
- 2. Access to the unit/building is the responsibility of the seller and as such the realtor will be deemed a guest and all rules, regulations and responsibilities regarding guests will apply.
Resale of Condominium
The Condominium declaration strictly prohibits anyone other than the developer from advertising any unit for sale or for lease in the building. The developer does allow a folder of units for “Lease” to be kept at the front desk for anyone who inquires about units for rent. The Board does have “The Right of First Refusal” as stated in section 14.01 of the Declaration.
Homeowners are NOT allowed to do the following:
- No flyers
- No MLS Sheets
- No signs and/or banners of any kind
- No distribution of flyers or other marketing materials
- No handing out agent cards
- No real estate agents other than Boveri Group are allowed to use the sales office
- Agents for owners of Metro condo units wishing to resale their units must make arrangements to show and gain access to the resale units thru the owner. The building staff is not allowed to give out keys to agents of re-sale units.
Homeowners are allowed to do the following:
- Leave a labeled key at the front desk so can be showed. However, the owner must contact the front desk to notify them of any showings. It is the same as having a visitor.
- They list their unit for sale on the website
- The front desk can keep a file of MLS Sheets in a binder
- Any all signage must be approved by the Board
Restrictions on Staff:
No staff member is allowed to accept any type of monetary reward or gift for aiding an owner in selling their unit. Any staff member accepting money or gift will be terminated without warning or notice.

Signs
No reflective materials, advertising, artwork, signs of any kind) including without limitation any signs relating to any business of any Owner) shall be installed, placed or hung on the exterior (or visible through windows) of any Unit or Common Elements other than blinds Approved by the Board. No clothing or other personal effects shall be placed upon or hung in view of the balcony or other exterior portion of any Unit or Common Elements unless the same are approved by the Board, except for flower pots or other such items which shall be properly maintained and in good and attractive condition. (Declaration Article IV, Section 4.01i).
Telephone Call Box
Directions for the outer lobby telephone are located on the call box. Once the party’s last name is found, dial the code that is located after their name. If unable to locate the party or having a problem please dial #0100 to contact the concierge at the front desk for assistance. At this time the guest will state their name and who they are visiting. The person working the front desk will ask them to come to the front desk. That person will contact that home owner for permission to allow their visitor to come up, if they (homeowner) have not already contacted the front desk prior.
Smoking
No smoking of any kind is permitted in any of the public areas of the building. Smoking
in the stairwells or any other public part of the building is a violation of city fire codes and
carries harsh fines. No owner shall permit any noxious, offensive, or unusual smells or odors of any kind to emanate beyond the boundaries of its unit (Rules and Regulations p. 2, Declaration Article IV, Section 4.01q).
Trash Disposal
Small Household Trash Items
Each floor is equipped with a trash disposal chute. Owners are responsible for properly bagging their trash prior to putting it down the chute. In the event that items are not properly bagged the chute will become clogged and require service.
Pizza Boxes and Other Cardboard
No pizza or cardboard boxes, package boxes included, should NEVER be thrown down the trash chute. Cardboard boxes are to be broken-down and delivered to the trash garage on the B2 level for disposal. Place them in the blue recycle dumpster or in the gray recycling bins marked cardboard.
Large Bulky Items or Construction Scarps
f you have large items, i.e. furniture, TV, computer, carpet, or mattress. You will need to dispose of the items yourself. Items are not allowed to be left or stored in hallways, stairwells, or other common areas. To arrange a pickup please contact Deffenbaugh at (913) 441-9660.
Electronic Equipment and Batteries
We encourage that you dispose of these materials responsibly. City drop-off recycling centers accept these items. For locations click here. These items contain lead, mercury, cadmium and other harmful elements. This equipment could be leaking harmful chemicals into groundwater from landfills.
Visitors
Visitors will not be given access via the emergency keys unless accompanied by the unit owner. Please arrange for access. Visitors must use the call box at the lobby level to gain access to the building (Rules and Regulations, p. 2).
Unit Access/Key Control
Keys to condos are required by law to be locked in a secure place for building emergencies only. Your keys will be locked in a key box. These keys are kept for emergency use only. They are not to be used as your spare set. Residents are required to make alternate key arrangements for housekeepers, deliveries, etc. The building keys will not be given out to nonresidents. Keys may be used in the case of a lockout for homeowner’s only. There will be a $40 charge for this service to the HOA (Rules and Regulations, p.
Unit Construction/Renovation
No unit owner shall make any structural addition, improvement or decoration to or of any limited common element which he has the right to use, including without limitation the addition of any awning or screen to any window or balcony, unless and until plans and specifications, in duplicate, showing the nature, kind, shape, height, color, materials, location and approximate cost of such addition, alteration, improvement or decoration has been submitted to and approved in writing by the Board of Directors (Declaration Article IV, Section 4.01d). Unit Maintenance
Each Owner shall maintain and keep its unit in good condition and repair, including the fixtures thereof, and other Limited Common Elements, if any, which are appurtenant to such Owner’s Unit. All Limited Common Elements, if any, associated with a Unit, shall be maintained and kept in good condition by the Owner of the Unit.
The Metropolitan Condominium is responsible for the maintenance and repair of the buildings common areas, mechanicals and building fixtures only. The Metropolitan Condominium will not be responsible for damage to your unit or any personal property from emergencies, water leaks, air conditioner leaks, etc (Rules and Regulations p. 2)
